MOW BROS LLC — SEASONAL SNOW & ICE AGREEMENT — PER-PUSH BID (2026-27)
Effective August 19, 2026
Season: Nov 1, 2026 – Apr 1, 2027. Bid price valid through Sept 30, 2026; agreements signed Oct 1 or later add 15%. This Agreement applies to both residential and commercial properties; provisions stated as applying to commercial properties apply where the Property is used for business purposes.
PRICING: Seasonal agreement, paid in installments — but no published GOOD/BETTER/PRIORITY catalog price. Each property’s season price is individually bid by Mow Bros, built per push: a per-push rate for this property’s scope and size multiplied by expected pushes for the season, plus buffer, then converted into the flat season price.
Good: driveway + walkways. De-icing NOT included.
Better: driveway + walkways + de-icing applied at time of scheduled service (front walkway and steps only).
Priority: driveway + walkways + de-icing at time of service + 0.5″ trigger.
TRIGGER: Service dispatches at 1″ accumulation (Good/Better) or 0.5″ (Priority). Snow under the trigger is not included; available on request, billed at Mow Bros’ standard one-time-service rate of $130/hour. Service hours: 24/7.
NO GUARANTEED RESPONSE OR CLEARING TIME. MOW BROS DOES NOT GUARANTEE ANY RESPONSE TIME, CLEARING TIME, OR SERVICE WINDOW UNDER ANY TIER, INCLUDING PRIORITY. Mow Bros dispatches as weather, storm severity, accumulation rate, equipment availability, crew availability, and route order allow. During heavy, prolonged, or back-to-back storms, service may be substantially delayed. Failure to service within any particular period is not a breach of this Agreement and creates no right to a refund, credit, offset, or damages. The Priority tier purchases a lower dispatch trigger and included de-icing, not a guaranteed arrival time.
PUSH DETERMINATION & BILLING. A push occurs each time Mow Bros dispatches to the Property because accumulation meets the applicable trigger. One continuous storm may produce more than one billable push. Mow Bros’ good-faith determination — based on its own observation and records at the Property — of whether the trigger was met and how many pushes occurred is controlling for billing purposes. Third-party weather reports and airport or regional measurements do not govern, as accumulation varies by location and surface.
ONE-TIME / NON-CONTRACT SERVICE: Any plow outside this Agreement — below-trigger requests, or a one-time or walk-in plow at any property — is billed at Mow Bros’ standard uniform rate of $130/hour, separate from the individually-bid per-push rate used to build the season price.
DE-ICING LIABILITY WAIVER – READ CAREFULLY: De-icing is applied at time of service only, never as a standing treatment between visits. If Customer’s tier does not include de-icing and Customer does not separately purchase it, Mow Bros provides snow-pushing ONLY and assumes NO LIABILITY for ice formation, refreeze, black ice, or any resulting injury (including slip-and-fall), vehicle damage, or property damage. Customer accepts this risk by signing. Even where de-icing is included, Mow Bros does not warrant a continuously ice-free surface between visits.
CUSTOMER RETAINS PREMISES RESPONSIBILITY. Mow Bros provides periodic snow and ice services only. Customer remains solely responsible for the safe condition of the Property between visits, including monitoring for ice, refreeze, and hazardous conditions, warning or restricting access as needed, and performing interim treatment. Nothing in this Agreement transfers to Mow Bros any duty Customer owes to occupants, employees, tenants, customers, guests, or the public to maintain safe premises, and Mow Bros does not assume any such duty. Where the Property is commercial, Customer is responsible for its own inspection, documentation, and premises-liability obligations.
THIRD-PARTY INJURY — DEFENSE & INDEMNITY. CUSTOMER WILL DEFEND, INDEMNIFY, AND HOLD MOW BROS HARMLESS from and against any claim, demand, suit, loss, judgment, cost, or expense, including reasonable attorney fees, brought by any third party — including guests, invitees, tenants, employees, delivery personnel, and members of the public — for bodily injury, death, or property damage occurring at or arising from the condition of the Property, including slip-and-fall claims. This obligation applies whether or not Mow Bros had recently serviced the Property, and applies except to the extent the claim is caused by Mow Bros’ own gross negligence or willful misconduct. Customer will maintain property and liability insurance appropriate to the Property and will tender any such claim to its insurer.
RELOCATION: Snow relocation, when piles fill available space, is billed hourly at $250 and is not included in the season price. Mow Bros determines pile placement using reasonable judgment; Customer is responsible for identifying in advance any area where snow may not be placed.
STAKING: Customer must stake driveway edges and beds by Oct 31. If not staked, Mow Bros may stake for a $75 fee or skip service to that property until staked. Vehicles in the driveway: crew works around them if the property is staked; that visit is skipped if it is not.
DAMAGE – NOT COVERED: Mow Bros is not responsible for damage to sod and turf edges, concrete, asphalt, pavers, curbing, unstaked landscape features, items concealed by snow, existing asphalt or concrete cracking, the surface actively being cleared during normal operations, or any damage caused by salt or de-icing agent application. Snow conceals the surface and everything on it; Customer accepts that some contact damage is inherent to mechanical snow removal.
REPORTING A CONCERN: The fastest way to resolve any service concern is to send Mow Bros a photo and brief description as soon as it is noticed. Customer must report any claimed property damage in writing within 72 hours of the service visit, or the claim is waived.
PAYMENT: Five equal monthly installments of the season price, due Nov 1, Dec 1, Jan 1, Feb 1, and Mar 1. No other payment structure or post-service billing is offered, except as stated in Push Determination & Billing and Relocation above. Late payment: 15% fee after a 5-day grace period; service suspended after 10 unpaid days. Suspension for non-payment is not a failure to perform, and Mow Bros is not liable for any condition arising at the Property during a suspension.
CANCELLATION: Mow Bros may cancel this Agreement at any time, for any reason, with written notice. Customer may cancel only for Mow Bros’ material breach left uncured 10 days after written notice. Upon cancellation, Customer owes only for services already performed, calculated at the per-push rate used to build the season price and other rates in this Agreement; any overpayment is refunded, any shortfall is due within 10 days.
LIABILITY CAP: Mow Bros’ total liability under this Agreement is capped at the total amount Customer has paid, except for personal injury caused by Mow Bros’ own negligence where such a limit is not permitted by law. Mow Bros is not liable for indirect, incidental, consequential, or punitive damages, lost profits, lost business, or loss of use.
WAIVER OF SUBROGATION: Customer waives, and will have their property insurer waive, any right of subrogation against Mow Bros for losses related to this Agreement.
Governed by Montana law; venue is Gallatin County or the county where the Property is located. Mow Bros may use qualified subcontractors. This Agreement, together with the selected tier and the signed quote establishing the season price and per-push rate, is the entire agreement between the parties for this season’s service. If any provision is unenforceable, it is narrowed or severed and the rest remains in effect.
