MOW BROS, LLC — RECURRING LAWN MAINTENANCE AGREEMENT
Effective August 19, 2026
This Agreement governs recurring lawn maintenance service between Mow Bros, LLC, a Montana limited liability company (“Mow Bros”), and the customer approving the Estimate (“Customer”) for the property identified in the Estimate (“Property”).
SEASON & TERM. For Customers who sign up before the season begins, the service season runs April 1 through October 31. For Customers who sign up mid-season, the season runs from the start date stated on the Estimate through October 31, and the season price is set accordingly. This Agreement does not renew automatically. Continuing service in a following season requires a new Estimate approved at then-current pricing.
SCOPE. Mow Bros provides mowing, trimming, and blowing of hard surfaces at the frequency and price stated in the Estimate. Where the Estimate includes a fertilization program, those treatments are provided as described on the Estimate and are governed by the Fertilization & Chemical Application section below. Anything not listed on the Estimate — aeration, dethatching, bed maintenance, irrigation work, storm damage, or one-time cleanups — is separate service, billed separately, and may require its own agreement.
SCHEDULING & WEATHER. Visit days are estimates, not guarantees. Mow Bros may adjust the schedule for weather, ground conditions, holidays, equipment, or crew availability, and is not liable for any loss arising from a delayed or rescheduled visit.
PROPERTY ACCESS & MISSED VISITS. Customer will provide safe, unobstructed access on each service day, including unlocked gates, pets secured indoors or restrained away from the work area, and the lawn clear of toys, hoses, furniture, pet waste, and debris that could be struck by mowing equipment. IF THE CREW CANNOT ACCESS THE PROPERTY OR WORK SAFELY FOR ANY REASON WITHIN CUSTOMER’S CONTROL — INCLUDING A LOCKED GATE, AN UNSECURED DOG, OR AN OBSTRUCTED LAWN — THAT VISIT IS BILLED AS DELIVERED AND IS NOT RESCHEDULED OR MADE UP.
CUSTOMER RESPONSIBILITIES. Customer is solely responsible for marking sprinkler heads and lines, invisible and pet fencing, landscape lighting, septic and drain systems, wells, drain tile, and any other hidden or shallow feature on the Property. Mow Bros is not liable for damage to anything unmarked, mismarked, shallow, or improperly installed, and repairs to those items are billable to Customer.
FERTILIZATION & CHEMICAL APPLICATION. Where the Estimate includes fertilization, weed control, or other chemical application, Mow Bros performs that work using licensed applicators in accordance with product label requirements and Montana Department of Agriculture rules. Mow Bros posts the Property as required by law; Customer is responsible for notifying household members, tenants, guests, and neighbors as Customer sees fit. CUSTOMER MUST KEEP CHILDREN, PETS, AND LIVESTOCK OFF TREATED AREAS FOR THE RE-ENTRY PERIOD STATED ON THE PRODUCT LABEL OR BY THE APPLICATOR. Customer must disclose in advance any vegetable garden, edible planting, fruit tree, pond, water feature, fish, beehive, sensitive ornamental, well, or any person or animal at the Property with a known chemical sensitivity. Results are not guaranteed: turf response depends on soil, weather, watering, mowing practices, existing turf health, weed pressure, seed banks, and drift from adjoining properties, none of which Mow Bros controls, and repeat applications are commonly required. Some drift is inherent to outdoor application; Mow Bros is not liable for damage to plantings within or adjacent to a treated area except where caused by its gross negligence or willful misconduct. Watering after application is Customer’s responsibility. Mow Bros may reschedule an application for wind, temperature, precipitation, or label restrictions without liability.
ADDITIONAL WORK. Work beyond the Estimate’s scope bills at Mow Bros’ then-current rate of $105 per hour plus materials at cost plus 20%, and requires Customer’s approval; email, text, or online approval counts as written approval.
PAYMENT. The season price is billed in equal monthly installments due the 1st of each month for the months service is provided, regardless of how many visits fall within a given month. Invoices are due within 15 days. Past-due balances accrue interest at the maximum rate Montana law allows. Customer authorizes Mow Bros to charge the payment method on file for any balance more than 10 days past due. Returned payments incur a $30 fee plus any bank fees. Customer pays reasonable collection costs, and the prevailing party recovers reasonable attorney fees. Mow Bros may suspend service on any account more than 15 days past due, and a suspension for non-payment is not a missed visit.
CANCELLATION. Mow Bros may cancel this Agreement at any time, for any reason, with written notice. Customer may cancel only for Mow Bros’ material breach left uncured 10 days after written notice describing the breach. Upon cancellation, Customer owes for all services already performed; any overpayment is refunded, and any shortfall is due within 10 days.
NO GUARANTEES. Mow Bros provides mowing and trimming to a commercially reasonable industry standard, not a specific cosmetic result. Mow Bros does not guarantee turf color, density, growth rate, or recovery from drought, disease, pests, or prior damage, all of which depend on weather, watering, soil, and existing turf health outside Mow Bros’ control.
CLAIMS & RIGHT TO CURE. Customer must notify Mow Bros in writing within 72 hours of a visit of any damage or service concern arising from that visit, or the claim is waived. Mow Bros gets a reasonable opportunity, not less than 10 business days, to inspect and address the issue before Customer hires anyone else or withholds payment for that visit.
LIMITATION OF LIABILITY. To the fullest extent Montana law allows, Mow Bros’ total liability for any claim arising from this Agreement will not exceed the amount Customer paid for the visit giving rise to the claim. Neither Party is liable for indirect, incidental, consequential, or punitive damages, lost profits, or loss of use. Nothing here limits liability for fraud, willful injury, or violation of law.
INDEMNITY & INSURANCE. Customer will indemnify Mow Bros against third-party claims arising from Property conditions, Customer’s acts or omissions, or Customer’s lack of authority to order service, except to the extent caused by Mow Bros’ own negligence or willful misconduct. Mow Bros carries general liability and workers’ compensation insurance; certificates available on request. Mow Bros may use qualified subcontractors and remains responsible to Customer for their work.
MARKETING & MESSAGES. Mow Bros may photograph work areas and use those images in marketing without showing Customer’s name, address, or interior spaces; Customer may opt out by telling Mow Bros in advance. Customer agrees Mow Bros may call, text, and email about service and account matters, including automated messages, and may opt out of marketing messages anytime by replying STOP.
GENERAL. Montana law governs; venue is Gallatin County or the county where the Property is located. This Agreement and the approved Estimate are the entire agreement between the Parties for recurring lawn maintenance service; the Estimate controls on scope, price, and schedule, and this Agreement controls on everything else. Changes must be in writing. If any part of this Agreement is unenforceable, it is narrowed or severed and the rest remains in effect.
By signing or approving the Estimate, Customer agrees to this Agreement and confirms authority to order recurring service for this Property.
