MOW BROS, LLC – ONE-TIME & ADD-ON SERVICE TERMS
Effective August 19, 2026
1. SCOPE. We do only the work listed on this estimate. One-time job, not recurring service. Estimate valid 30 days. If we find hidden conditions (buried debris, unmarked lines, hazardous material), we stop and get your written OK before continuing or charging more; debris volume is handled under Section 6 instead. Email, text, and electronic approval count as writing. NO LADDER, ROOF, OR GUTTER WORK. We do not climb ladders, go onto roofs, or clean gutters or downspouts, and nothing on the estimate should be read to include that work.
2. ACCEPTANCE. Binding when you sign, approve electronically, or tell us to start. Electronic approval equals a signature. You confirm you own the property or have the owner’s permission. Renters, managers, and agents are personally responsible for the bill.
3. SCHEDULING & CANCELING. Dates are estimates; weather and equipment can push them. Cancel with 48 hours’ notice. With less notice, or if we can’t work due to locked gates, unsafe conditions, vehicles in the way, or an uncleared area, you’re charged $150 or 25% of the estimate, whichever is greater, plus any special-order materials. Deposits are earned once we schedule. Both sides agree these amounts are a fair estimate of our actual cost, not a penalty.
4. PAYMENT. Due on completion unless the estimate says otherwise; invoices due in 15 days. Late balances accrue interest at the maximum rate Montana law allows. You authorize us to charge the payment method on file for any balance more than 10 days past due. Returned payments are $35 plus bank fees. You cover reasonable collection costs and attorney fees. Bring problems to us under Section 9 before filing a chargeback. We can pause work on past-due accounts.
5. YOUR RESPONSIBILITIES. Provide clear access and secure pets. MARK EVERYTHING HIDDEN BEFORE WE ARRIVE: sprinkler lines and heads, private utility lines, invisible fence, landscape lighting, septic, wells, cables, drain tile, and anything else shallow or buried. Leaves, snow, and debris conceal all of it, and our equipment cannot see through them. We are not responsible for damage to anything unmarked, mismarked, shallow, or badly installed, and repairs to those items are billable to you. On digging jobs we call 811 for public utilities only — 811 does not locate private lines. HOA rules and permits are yours.
6. HAULING & DEBRIS VOLUME. Your estimate states the number of truckloads included and the rate for those loads. Actual volume is confirmed on site. Any load beyond the number stated on the estimate bills automatically at $95 per truckload, and we keep working rather than stopping — by approving the estimate you authorize that charge in advance. This overage rate applies only to loads past the estimated count; loads within the estimate bill at the estimate’s rate. We haul only the material types on the estimate; other material bills as extra. We do not haul hazardous waste, paint, chemicals, fuel, oil, asbestos, batteries, tires, refrigerant appliances, propane tanks, medical waste, animal waste or carcasses, ammunition, contaminated soil, or anything the landfill refuses. If found, we stop, and disposal plus any fines are yours. CLEAR OUT ANYTHING YOU WANT TO KEEP BEFORE WE ARRIVE. Once loaded, material is ours and gone, and we are not liable for items hauled away. Dump fees at cost unless the estimate includes disposal.
7. FERTILIZER & WEED CONTROL. Applied by licensed applicators per label and Montana Dept. of Agriculture rules. We post the property; you notify your household and neighbors. Keep kids, pets, and livestock off treated areas for the label re-entry time. Tell us ahead about gardens, fruit trees, ponds or fish, beehives, wells, sensitive plants, or chemical sensitivities. No guaranteed results. Outcomes depend on soil, weather, watering, mowing, turf health, and neighbor drift, and repeat applications are normal. Watering afterward is on you. Some drift is unavoidable outdoors; we are not liable for plant damage in or near a treated area absent gross negligence or willful misconduct. We may reschedule for wind, temperature, or rain.
8. PHOTOS AND THE RECORD OF CONDITION. We photograph the work area before and after service and send you those images. Those photographs are the agreed record of the property’s condition when we arrived and when we finished. If you claim damage that does not appear in the after photos, it is presumed we did not cause it, and the burden is on you to show otherwise. If you believe the photos do not fairly show the work area, tell us in writing within the Section 9 window.
9. CLAIMS. We work to commercially reasonable industry standards, not perfection or a specific cosmetic result. TELL US IN WRITING WITHIN 72 HOURS of service about any damage or problem, or the claim is waived. Give us 10 business days to inspect and fix it. If you hire someone else first, we do not cover their bill. Section 8 applies to every claim under this section.
10. WARRANTIES & LIABILITY. Work is provided AS IS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. No guarantee of appearance, plant survival, weed or pest eradication, cleanup completeness, soil, or drainage. To the fullest extent Montana law allows, we are not liable for damage to lawns, landscaping, plants, trees, irrigation, hardscape, concrete, fencing, lighting, or underground systems except from our gross negligence or willful misconduct. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED WHAT YOU PAID US FOR THAT JOB. NEITHER SIDE IS LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS, LOST RENT, LOSS OF USE, OR DROP IN PROPERTY VALUE. These sentences stand on their own; if one fails the others apply. Nothing here limits liability for fraud, willful injury, or violation of law. You will cover us for third-party claims from pre-existing conditions, unmarked systems, hazardous material, your breach, or actions by you, your household, or your other contractors. We carry general liability and workers’ comp; certificate on request. We may use qualified subcontractors and stay responsible to you.
11. MARKETING & MESSAGES. We may use work-area images in marketing, without your name, address, or interior photos. Tell us beforehand to opt out. You agree we can call, text, and email you about your service and account, including automated messages, plus marketing you can stop anytime by replying STOP.
12. LEGAL. Montana law governs; suits go in Gallatin County or the county where the work was done. The winning side gets reasonable attorney fees and costs. We reserve all Montana lien rights, including construction liens under Title 71, Ch. 3; this plus your estimate is the written contract for that purpose. This and your approved estimate are the whole agreement; the estimate wins on scope, price, and schedule, these terms win on everything else. Changes must be in writing. Sections 4 and 8 through 12 survive completion. If any part is unenforceable it is narrowed or dropped and the rest stands.
By signing or approving your estimate you agree to these terms and confirm you have authority to hire us for this property.
